To provide our clients our services in consultation and transaction, we collect, use and disclose information on a regular basis. Confidentiality is important to us, and protecting personal information is one of our priorities. We use all information, especially personal information, in accordance with the highest ethical standards.
This Privacy Policy applies to visitors of the websites operated by Northam Law located at www.northam-law.com and our social media sites (collectively referred as “Sites”) and to individuals who provide personal information to us (whether via website, client portal, by email, in person, or over the phone), engage with us on social media, apply for a job opportunity or otherwise participate in or use any programs or services we may offer, such as our promotional activities and contests. By providing personal information to us, you agree to the processing set out in this Privacy Policy and authorize Northam Law, its third parties and service providers to process your personal information for purposes set out in this Privacy Policy.
This Privacy Policy does not apply to, and Northam Law is not responsible for, any third party websites which may be accessible through links from our Sites. If you follow a link to any of these third party websites, they will have their own privacy policies and you will need to check these policies before you submit any personal information to such third party websites.
This Privacy Policy also does not apply to business information or information generally made available to the public.
Changes may be periodically made to this Privacy Policy. CONSENT
The primary basis on which we collect, use and disclose your personal information is with your consent, unless otherwise permitted or required by law. How we obtain your consent will depend on the circumstances, as well as the sensitivity of the information collected. Subject to applicable laws, your consent may be express or implied, depending on the circumstances and the sensitivity of the personal information in question. If you choose to provide personal information to us, we assume that you consent to the collection, use and disclosure of your personal information as outlined in this Privacy Policy.
Typically, we will seek your consent at the time your personal information is collected. Where we want to use your personal information for a purpose not previously identified to you at the time of collection, we will seek your consent prior to our use of such information for this new purpose.

For the purposes of this Privacy Policy, “Personal Information” means information about an identifiable individual, but does not include the name, title, business address or telephone number of an employee of an organization where the name, title, address or telephone number is used for a business purpose or made generally available to the public.

Collection of personal information by itself does not create lawyer-client relationship. The use of the Sites, email, or such other means to communicate with Northam Law does not create lawyer-client relationship or fiduciary relationship. The Sites may not be used to request legal advice or to transmit any confidential information relating to the provision of legal advice. Information transmitted to Northam Law through the use of the Sites may not be treated as confidential and is not protected by solicitor-client privilege.
When you choose to subscribe to our newsletters, we will collect your name, address, telephone number, email address and any additional details you choose to provide to us when you complete the form located in the subscription area of our Sites. We will use this Personal Information solely for the purposes of including your information in our database and in our mailing list.
Types of Personal Information Collected
We collect the following types of information from you:
- Personal Information: This includes first name, last name, birth date, information from government-issued identification cards, client intake forms, and from such other sources where personal information is available and communicated to Northam Law;
- Contact Information: This includes information such as your address, phone number, email address, and other contact information.
- Information From Linked Accounts: This includes information about you that you provided through interaction with our Sites;
- Usage and Technical Information: Information relating to how you interact with our Sites. Such information may include your Internet protocol address, information about your devices, browser and operating system, how you are using our Services, and the date and time of your visit;
- Billing, Payment, and Financial Information: This includes information such as billing address, bank account, and payment information collected to settle bills, accounts, and disbursements;
- Website Forms: Information that you submit to us on our Sites. This includes your name, email address and other contact information;
- Marketing, Surveys, Contests: Where you sign up for our marketing communications, or participate in our surveys or contests, we will collect information such as your name, address, email address and phone number to send you communications.
Information collected is not meant to be excessive and shall be used responsibly in accordance with the agreed intent.
You cannot send us confidential information until we have confirmed in writing that we represent or act for you or your company or organization. Unsolicited emails sent to us from non-clients do not establish a lawyer-client relationship or fiduciary relationship. They may not be privileged and, therefore, are subject to disclosure to third parties.
COOKIES AND AUTOMATIC SYSTEMS
We use cookies and other mechanisms to track information about use of our Sites. We may combine this information with other information we collect about a person.
- Cookies. A cookie is a text file that a website transfers to a device for record-keeping purposes. We may use cookies to track user activities on our Sites, such as the web pages they view and time they spend on those pages. - Clear GIFs, Pixel Tags and Other Technologies. Clear GIFs are tiny graphics with a unique identifier, similar in functionality to cookies, which are embedded invisibly on web pages. We may use clear GIFs (also known as web beacons, web bugs, pixel tags, or action tags, among other names), in connection with our Sites to perform functions like tracking the activities of visitors to our Sites, helping us manage content, and compiling statistics about usage of our Sites. We may also use clear GIFs in emails to help us track email response rates, identify when our emails are viewed, and track whether our emails are forwarded.
- Embedded Scripts. We use embedded scripts, which is code designed to collect information about how visitors interact with a website, such as the website which linked them to our Sites.
- Third Party Analytics. We use service providers, such as Google Analytics, to evaluate the use of our Sites. We may use automated devices and applications to evaluate use of our Sites. We use these tools to help us improve our Sites performance and user experiences. These entities may use cookies and other tracking technologies, such as web beacons, to perform their services.
- Cookie Opt-Out. You can prevent cookies from being saved by changing the preferences of your browser software accordingly. However, we would like to point out that in this case you may not be able to use all functions of this Site to its full extent. USE OF PERSONAL INFORMATION
We may use your personal information and other information that we collect to provide you with our services and programs, to manage our business operations, to communicate offers and information we think might interest you, to generally enhance your customer experience with us, to comply with our contractual obligations, and to support our legitimate interests in maintaining, improving and advertising our services. - to contact you in relation to your file and our services;
- to identify any potential conflict of interest and assess whether we can provide you with legal services;
- to perform due diligence in to fight against fraud and in compliance with anti-money laundering laws, rules, and regulations;
- with your consent, to provide you with information that we think may interest you, including marketing communications;
- to enforce our legal rights, comply with legal and regulatory requirements, and/or protect rights of third-parties where required by law; and
- to re-organize or make changes to our business as part of due diligence and as may be required by law.
We may use your personal information and other information for purposes for which we have obtained your consent, and for such other purposes as may be permitted or required by applicable law.
SHARING OF PERSONAL INFORMATION
Sharing with Third Parties
We share your personal information with third party service providers who perform some services on our behalf, such as file maintenance providers, facilitating and ensuring seamless service. We also share your information with third party service providers who provide products and services that we use to operate our business, such as payment processing, email services, marketing campaigns, job applications and alerts, employee management, surveys and contests.
If we provide your information to service providers to support our business, then we require those service providers to maintain the confidentiality of your personal information and keep your personal information secure. We also require that they only use your personal information for the limited purposes for which it is provided. When our service providers no longer need your personal information for those limited purposes, we require that they dispose of the personal information. In some circumstances, we may permit our service providers to retain anonymized or statistical information that does not identify you. We do not authorize the service providers to disclose your personal information to unauthorized parties or to use your personal information for their direct marketing purposes. At Northam Law’s discretion, we may share statistical data with third party market researchers. This information is anonymized. We do not sell your personal information to any organization or person; the only exception to this would be if we sell or transfer any part of our business. We will not share your personal information with any non-affiliated third party without your prior consent, other than as provided in this Privacy Policy or as otherwise authorized by applicable law.
Other Disclosures
Additionally, we may disclose your information when we believe such disclosure is permitted, necessary or appropriate:

- to respond to requests from public and government authorities, including public and government authorities outside your country of residence;
- to enforce the terms of the agreements for our products and services;
- to protect our operations or those of any of our affiliates or subsidiaries;
- to protect our rights, privacy, safety or property, and/or those of our affiliates, you or others; and
- to allow us to pursue available remedies or limit the damages that we may sustain.
In addition, we may transfer your personal information and other information to a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, brands, affiliates, subsidiaries or other assets.
If we otherwise intend to disclose your personal information to a third party, we will identify that third party and the purpose for the disclosure and obtain your consent.
OPTING OUT OF COMMUNICATIONS
If you no longer want to receive marketing-related emails from us, you may opt out of receiving marketing-related emails by clicking the “unsubscribe” link at the bottom of any email you receive from us. You may also opt out by contacting us directly using the contact information on our Sites.
We will endeavour to respond to your opt-out request promptly, but we ask that you please allow us a reasonable time to process your request. Please note that if you opt out from receiving marketing-related emails, we may still need to send you communications about your use of our products or services, or other matters.
RETENTION OF PERSONAL INFORMATION
We will keep your personal information for as long as we need it to fulfill the purposes set out in this Policy, or as required by applicable laws, regulations, or government orders. After the relevant amount of time has passed, we will securely delete your information. Some files may be retained for an extended period such as those relating to real estate files, family law, corporate law files and wills and estates. SECURITY MEASURES
We have implemented commercially reasonable physical, organizational, contractual and technological security measures with a view to protecting your personal information from accidental or unlawful destruction, loss or theft, unauthorized access, disclosure, copying, use or modification. Only designated staff at Northam Law will have access to your submitted personal information.
Despite the measures outlined above, no method of information transmission or information storage is 100% secure or error-free, so we unfortunately cannot guarantee absolute security. In the case of a breach of security safeguards, we will act promptly to mitigate the risks and to inform you where there is a real risk of significant harm, or as otherwise required by law.
If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of any information that you provided to us has been compromised), please contact us immediately using the contact information on our Sites.
TRANSFER AND STORAGE OF INFORMATION
Personal information may be processed in any country where we have facilities or in which we engage third party service providers to fulfil the purpose for which we collected the personal information. As a result, your personal information may be transferred to countries outside your province or country of residence, which may have different data protection rules than where you are. While such information is outside of your province or country, it is subject to the laws of the country in which it is located, and may be subject to disclosure to the governments, courts or law enforcement or regulatory agencies of such other country, pursuant to the laws of such place.
Our practices regarding your personal information will at all times continue to be governed by this Privacy Policy and we will continue to comply with all applicable legal requirements.
YOUR PERSONAL INFORMATION RIGHTS
Right of Access
You may request to access to the personal information that we hold about you. Upon a written request, we will provide you with your personal information as privacy laws mandate. Before granting your request, you may first be asked to provide proof of your identity. If this request is granted, your information will be provided within 30 business days after your request, unless granted a time extension under the Personal Information Protection Act (“PIPA”).
Right to Correction
If you believe that the personal information we hold about you is incorrect or incomplete, you may also challenge its accuracy. Should you prove that there’s an error or incompleteness, we will update your personal information accordingly.
Right to Consent Withdrawal
You may withdraw your consent to the use, disclosure and retention of your personal information. How this request is handled depends on the situation and the purpose for which it is made. Depending on the case:
- you may be able to withdraw your consent, but we will no longer be able to offer you a service that depends on it;
- you will not be able withdraw your consent because the processing of your personal information is necessary or compulsory under applicable law, such as for tax purposes.
In all cases, we may be required to keep certain personal information to comply with our legal obligations.
Please note that such rights are not absolute. There may be legal or regulatory circumstances that allow us to refuse to provide some or all of the personal information that we hold about you. In cases where we cannot fulfill your request to access, correct, or delete your information, we will explain the reasons, except where we are restricted by law.
We may require that you provide sufficient identification to fulfill your request to access or correct your personal information. Any such identifying information will be used only for this purpose. We will not charge you any fees to access your personal information in our records without first providing you with an estimate of the approximate fees, if any.
THIRD PARTY WEBSITES AND SERVICES
This Privacy Policy applies only to our services. This Privacy Policy does not extend to any websites or products or services provided by third parties. We encourage you to review all third party privacy policies prior to using third party websites or products or services.
CHILDREN’S INFORMATION
Our Sites are not intended for children under the age of 16. Children under the age of 16 should not use our Sites. If we learn that we have collected or received personal information from a child under 16 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 16 without the consent of their parent or legal guardian, please contact us per the “contact us” section below.
